TERMS AND CONDITIONS

These Terms and Conditions ("Terms", "T&M", or "Agreement") govern all services provided by DFW Rug and Carpet Cleaning ("Company", "we", "us", or "our"). By requesting, scheduling, authorizing, or receiving any services from DFW Rug and Carpet Cleaning, you ("Customer", "Client", or "you") acknowledge that you have read, understood, and agreed to be legally bound by these Terms in their entirety. If you do not agree, you must not use our services.
1. SERVICES PROVIDED
DFW Rug and Carpet Cleaning provides, but is not limited to, the following services throughout the Dallas–Fort Worth (DFW) area:

Residential carpet cleaning

Commercial carpet cleaning
-
Area rug cleaning (all types)
-
Rug spot, stain, and odor removal
-
Carpet spot, stain, and odor removal
-
Upholstery cleaning
-
Rug repair services
-
Rug restoration services
-
Rug pickup and delivery services
All services are provided on an as-is and as-available basis.
2. NO GUARANTEE OF RESULTS
While we use industry-standard methods, professional-grade equipment, and trained technicians, DFW Rug and Carpet Cleaning makes no guarantees, warranties, or promises—express or implied—regarding the outcome of any service. Certain stains, odors, wear, discoloration, pet damage, dye instability, prior treatments, age-related deterioration, or manufacturing defects may not be removable and may worsen despite best efforts.
Customer understands and accepts that cleaning, repair, or restoration may result in:

Color variation or fading
-
Fiber weakening or breakdown
-
Shrinkage or stretching
-
Permanent stains remaining
-
Texture changes
-
Pre-existing damage becoming more visible
The Company shall not be held responsible for any such outcomes.
3. CUSTOMER RESPONSIBILITIES
The Customer agrees to:

Provide accurate information about rugs, carpets, upholstery, materials, prior damage, age, and prior cleaning history

Remove fragile, valuable, or personal items from service areas
-
Secure pets and ensure safe access to the premises
-
Ensure utilities (water, electricity) are available when required
-
Inspect all work upon completion
Failure to disclose relevant information releases the Company from all liability.
4. PRE-EXISTING CONDITIONS
DFW Rug and Carpet Cleaning is not responsible for:
-
Pre-existing damage, including but not limited to dry rot, insect damage, pet damage, sun fading, prior improper cleaning, dye bleeding, wear patterns, buckling, or delamination

Rugs or carpets previously treated by other companies or individuals
Customer agrees that the Company is not liable for worsening of pre-existing conditions.
5. RUG PICKUP, DELIVERY, AND STORAGE

Rugs left in our care are handled with reasonable care; however, storage, transportation, and handling involve inherent risks
-
The Company is not responsible for damage due to age, fragility, environmental factors, or structural weakness
-
Rugs left unclaimed for more than 30 days after service completion may incur storage fees
-
Rugs unclaimed after 90 days may be considered abandoned and disposed of or sold at the Company’s discretion without liability
6. PAYMENT TERMS

Payment is due immediately upon completion of services unless otherwise agreed in writing
-
Failure to pay may result in collection actions, liens, or legal remedies
-
Customer agrees to pay all collection costs, including attorney’s fees and court costs
All sales are final. No refunds are guaranteed.
7. LIMITATION OF LIABILITY
To the fullest extent permitted by law:

DFW Rug and Carpet Cleaning’s total liability shall not exceed the amount paid by the Customer for the specific service rendered

The Company shall not be liable for indirect, incidental, consequential, special, or punitive damages
This limitation applies to all claims, including but not limited to negligence, breach of contract, or misrepresentation.
8. INDEMNIFICATION
Customer agrees to indemnify, defend, and hold harmless DFW Rug and Carpet Cleaning, its owners, officers, employees, agents, and subcontractors from any and all claims, damages, losses, liabilities, costs, or expenses arising from:

Services performed
-
Customer’s failure to disclose information
-
Customer’s property conditions
-
Third-party claims
9. INDEPENDENT CONTRACTORS & SUBCONTRACTORS
The Company may utilize independent contractors or subcontractors. All protections, limitations, and disclaimers within these Terms extend fully to them.
10. DISCLAIMER OF WARRANTIES
ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not sell, rent, or share personal information except as required by law.
Data Security
We take reasonable steps to protect customer data but cannot guarantee absolute security. Customer acknowledges inherent risks of electronic communication.
12. GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of Texas.
Any dispute, claim, or legal action arising from or related to these Terms or services provided shall be filed exclusively in Tarrant County, Fort Worth, Texas. Customer expressly consents to this jurisdiction and venue.
13. MODIFICATIONS TO TERMS
DFW Rug and Carpet Cleaning reserves the absolute right to modify, revise, rewrite, or update these Terms and Conditions at any time, without prior notice or announcement. Continued use of services constitutes acceptance of the most current version.
14. SEVERABILITY
If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
15. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the Customer and DFW Rug and Carpet Cleaning and supersede all prior discussions or agreements.
